Terms and Conditions for Dinox Tech

Welcome to Dinox Tech (“we,” “us,” or “our”). By accessing or using our website, services, or products, including shared hosting, VPS hosting, cloud computing, domain registration, and related services (collectively, the “Services”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). These Terms, along with our Privacy Policy and any additional policies referenced herein, form a legally binding agreement between you and Dinox Tech, a hosting company operating in India. If you do not agree with these Terms, please do not access or use our Services.

Important Note: We have implemented these Terms to protect our Services from misuse, particularly by spammers or fraudulent users. If you are a legitimate user, rest assured that we are committed to supporting you with 24×7 technical support and high-quality service.

1. Acceptance of Terms

By visiting our website, creating an account, purchasing Services, or using our Services, you agree to these Terms, including any additional terms, conditions, or policies referenced herein or available via hyperlink. These Terms apply to all users, including browsers, customers, vendors, merchants, and contributors of content.

2. Services Provided

Dinox Tech provides web hosting, domain registration, and related services, including but not limited to:

  • Shared Hosting
  • Virtual Private Server (VPS) Hosting
  • Cloud Hosting
  • Domain Name Registration
  • SSL Certificates
  • Email Hosting

We reserve the right to modify, suspend, or discontinue any Service at any time without notice, subject to our refund policies.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years old or have the legal capacity to enter into contracts.
  • Provide accurate, complete, and current information during account registration.
  • Maintain the security of your account credentials and notify us immediately of any unauthorized access.

4. Account Responsibilities

  • Accuracy: You are responsible for providing accurate and up-to-date information during account creation and for maintaining its accuracy.
  • Security: You are responsible for safeguarding your account credentials and for all activities conducted under your account.
  • Prohibited Use: You agree not to use our Services for any unlawful, abusive, or prohibited activities, as outlined in Section 6.

5. Payment and Billing

  • Payment Terms: All payments for Services are processed in Indian Rupees (INR) through Razorpay, our secure third-party payment gateway. Payments for paid Services must be made in advance of each service term (monthly, annually, or as specified).
  • Free Hosting Offer: Dinox Tech offers free hosting services for an initial period of one (1) year from the date of account activation. After this period, the hosting service may continue as free or transition to a paid service based on the prevailing market value, as determined by Dinox Tech. Customers will be notified at least 30 days prior to any transition to paid services via the primary email address on file.
  • Verification Charge: To prevent fraudulent or spamming accounts, a small, one-time verification charge (in INR) is required during account registration. This charge is non-refundable and ensures the integrity of our Services.
  • Automatic Renewal: Paid Services set to auto-renew will be charged automatically using the payment method on file. You may disable auto-renewal through your account settings.
  • Non-Payment: Failure to make payments, including the verification charge, within 10 days of the due date may result in a notice of disconnection. If payment is not secured within 10 days of notice, we reserve the right to suspend or terminate your Services.
  • Taxes: All fees are exclusive of applicable taxes, which will be added as required by Indian law, including Goods and Services Tax (GST).

6. Acceptable Use Policy

You agree to use our Services in compliance with applicable Indian and international laws and these Terms. The following activities are strictly prohibited on our Services:

  • Hosting or transmitting illegal material, including copyrighted works without permission, commercial audio, video, or music files (e.g., MP4, MP3, OGG, MOV, AVI, MKV) on shared hosting, or any material violating Indian laws.
  • Hosting adult material, including pornography, erotic images, or obscene content (18+ content in any format).
  • Operating IRC (Internet Relay Chat) networks, autobot websites, BitTorrent applications or trackers, or gaming servers (e.g., Counter-Strike, Half-Life, Battlefield 1942).
  • Engaging in phishing, satta (gambling), fraudulent activities, malware distribution, or crypto/loan/spam-related content.
  • Running web spiders, indexers, stand-alone server-side processes, daemons, or proxy services.
  • Participating in file-sharing or peer-to-peer activities.
  • Using the Services as an offsite backup facility; all uploaded files must be web-visible and related to the operation of your website.
  • Sending unsolicited emails (spam), abusive, offensive, or fraudulent communications.
  • Overloading our servers or engaging in activities that disrupt the performance of our Services, such as excessive use of CPU, memory, or bandwidth (e.g., more than 5% of server processing capacity).

Violation of this policy may result in immediate suspension or termination of your Services without refund. If abuse is reported, your account will be suspended, and you may be required to pay a penalty (in INR) to reinstate services after removing the offending content. Repeated violations may lead to permanent termination.

7. Technical Support

  • Availability: We provide 24×7 technical support for hosting-related issues via email, phone, or our support portal.
  • Scope: Support is limited to issues caused by our hosting infrastructure. If a problem arises from a script or software you install, we will investigate to determine the cause. If the issue is due to our hosting, we aim to resolve it within 30 minutes. Other issues will be addressed within 24 hours, depending on complexity.
  • Premium Support: With premium support (available for an additional fee), we may attempt to resolve issues via remote access (e.g., AnyDesk). Developer support for custom scripts or software is not provided.
  • Customer Responsibility: You are responsible for maintaining updated anti-virus software and ensuring your website or scripts do not introduce vulnerabilities.

8. Viruses and Destructive Activities

If a virus, worm, Trojan, or other malicious code is detected in your cPanel or website, your account will be suspended immediately. To resolve this, you must contact our support team at [Insert Contact Email]. You are responsible for removing the malicious content, and we may require a penalty payment (in INR) to reinstate your account. We recommend using anti-virus software and keeping it updated to prevent such issues.

9. Refund Policy

Dinox Tech offers a 15-day credit-back guarantee (with a 5-day full refund period) on web hosting packages, subject to the following conditions:

  • Eligibility: Refunds are applicable only to annual hosting plans.
  • Non-Refundable Services: No refunds are provided for domain registrations, verification charges, SSL certificates, installation fees, licenses, or custom software installations.
  • Single Refund: Refunds are limited to one per customer. Multiple services or signups do not qualify.
  • TOS Violations: Accounts closed for violations of these Terms (e.g., email marketing, abuse, misuse, illegal/immoral content, or overuse) are not eligible for refunds.
  • Upgrades/Downgrades: No refunds are provided for plan upgrades or downgrades.
  • Canceled Plans: Canceled plans expire immediately without refund, and we are not responsible for data backups of canceled plans.
  • New Orders: If you already have a product and order a new one, only a 10-day credit-back guarantee applies.
  • No Issues Found: No refunds will be issued if our team finds no issues with your hosting plan from our side.

10. Intellectual Property

  • Your Content: You retain ownership of all content you upload to our servers (e.g., website files, databases, emails). You grant us a limited, non-exclusive license to store, process, and manage this content to provide the Services.
  • Our Intellectual Property: All content, trademarks, and materials on our website and Services, including logos, designs, and software, are owned by or licensed to Dinox Tech and are protected by intellectual property laws.
  • Prohibited Content: You may not upload content that infringes on third-party intellectual property rights, including copyrights, trademarks, or patents.

11. Domain Registration

  • Registrar Requirements: Domain registration is subject to the terms of the respective domain registrar and ICANN policies. You agree to provide accurate registrant information and comply with registrar policies.
  • WHOIS Data: Certain domain registration details may be publicly available through WHOIS databases unless privacy protection is enabled.
  • Non-Refundable: Domain registrations and renewals are non-refundable.

12. Service Availability

We strive to maintain 99.9% uptime for our Services but do not guarantee uninterrupted or error-free service due to the nature of computer and telecommunications systems. Our Web hosting is unlimited but limited to 1GB per SQL database and 10GB per mailbox. We are not liable for interruptions, downtime, or data loss, except as outlined in our Service Level Agreement (SLA), if applicable.

13. Termination and Suspension

  • By You: You may terminate your Services by disabling auto-renewal in your account settings or providing written notice as per your service term. No refunds will be provided for canceled plans unless specified in our Refund Policy.
  • By Us: We reserve the right to suspend or terminate your Services at our sole discretion, with or without notice, for reasons including but not limited to:
    • Violation of these Terms or the Acceptable Use Policy.
    • Non-payment of fees, including the verification charge or penalties for abuse.
    • Suspected fraudulent, illegal, or abusive activity (e.g., phishing, malware, spamming).
    • Actions that harm our infrastructure or other customers (e.g., excessive resource usage).
  • Data Deletion: Upon termination, we may delete your data from our servers unless otherwise required by law or agreed upon in writing. We are not responsible for backing up your data unless explicitly stated in your service plan.

14. Limitation of Liability

Our total liability shall not exceed the amount paid by you for the Services in the preceding 12 months. We are not liable for:

  • Issues arising from your actions, omissions, or equipment.
  • Losses due to factors beyond our reasonable control.

15. Indemnification

You agree to indemnify, defend, and hold harmless Dinox Tech, its officers, employees, agents, affiliates, and service providers from any claims, liabilities, losses, or damages, including reasonable attorney’s fees, arising from:

  • Your breach of these Terms or violation of applicable laws.
  • Your use of the Services, including any content you upload.
  • Any injury, damage, or infringement caused by products or content hosted on our servers.
  • Any breach of third-party intellectual property rights.

16. Force Majeure

Neither party shall be liable for any failure to perform obligations under these Terms due to circumstances beyond their reasonable control, including acts of God, war, riots, fire, floods, network failures, or government actions.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Services shall be resolved through arbitration in Mumbai, India, in accordance with the Arbitration and Conciliation Act, 1996. The language of arbitration shall be English.

18. Changes to These Terms

We reserve the right to update or modify these Terms at our sole discretion by posting the updated version on our website with the “Last Updated” date. Continued use of our Services after such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

19. Reporting Misuse

To report misuse (e.g., spam, phishing, malware, or illegal content), please provide the following details to [Insert Contact Email]:

  • Port Scanning/Hacking: Unedited firewall logs with time, date, and time zone, plus confirmation of your system’s clock accuracy.
  • Email/Newsgroup Misuse: Full email headers and content.
  • Virus Activity: Email headers, content, and attachments (zipped if necessary). We do not provide support for virus removal; you must use anti-virus software.
  • Web Space Abuse: URL, time, date, and a description of the infringement.

Reports will not be investigated without sufficient details. Dinox Tech actively cooperates with law enforcement and agencies like the Internet Watch Foundation to address illegal activities, including child abuse content.
